The mum claimed she acted out of ‘maternal instinct’ when she stabbed the 68-year-old man she shared a house with, leaving him hospitalised with serious injuries
A mum stabbed her tenant after he was reportedly seen masturbating in front of her two young children. Retiree Genaro Benjamin Diaz was found in Buenos Aires, Argentina, with stab wounds to his neck, chest and face on Friday.
The 68-year-old had recently moved in with Magali Daniela Ojeda, 28. The mum had decided to rent out a room at her 523rd street home in order to secure an income source while she was unemployed.
On Friday however authorities were alerted after Diaz was reportedly found injured between 19th and 18th street in Tolosa in the La Plata district, reports TN. He was rushed to the San Roque Regional Hospital, where he remains in a serious condition.

Ojeda was subsequently arrested and the case was passed to Functional Instruction Unit 15 under the watch of prosecutor María Cecilia Corfield. Officials initially suspected the case to be an attempted homicide.
However, according to news outlet 0221, Ojeda’s testimony to the prosecution claimed she acted out of “maternal instinct and to prevent possible abuse”.
It came after she spotted the tenant performing a sex act in front of her nine-year-old daughter and seven-year-old son.
It prompted the prosecution to order her release after a decision was made not to charge her. The woman’s lawyers had also argued for the case to be dismissed.
They stressed that she had no previous convictions and had co-operated with the investigation. The prosecutor concluded that she had acted in a way that would “prevent a greater harm”.
An investigation into the circumstances is however continuing.
Ojeda remains under investigation and a restraining order has reportedly been issued against both the man and his family.
The defense , led by Juan Manuel Fontana and Isidro Dignian, will however attempt to get the case dismissed.
They will claim she acted “to preserve the lives of her minor children.”
